Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Wrap It Up ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Wrap It Up, operated by Jabeja CommV (VAT: BE 1018138823), a company registered in Belgium ("we", "our", or "us").

2. Service Description

Wrap It Up is a mobile application that uses artificial intelligence to enhance product photographs. The App provides:

• AI-powered photo enhancement
• Custom AI mode creation
• Image-to-image fusion capabilities
• Cloud photo storage with cross-device access (mobile app and wrapitup.be/gallery)
• Secure photo gallery management with download capabilities

3. User Accounts

3.1 Account Registration

To access premium features, you must create an account:

Account Requirements:

• Provide a valid email address
• Choose a secure password (minimum 8 characters, with uppercase, lowercase, and number)
• Or sign in with Google/Apple OAuth

3.2 Account Security

You are responsible for:

• Keeping your password confidential
• All activity under your account
• Notifying us immediately of any unauthorized access

3.3 One Account Per Person

• You may create one account per email address
• Sharing accounts is prohibited
• Violators may lose access without refund

4. Credit System & Subscriptions

4.1 Free Tier & Initial Credits

Initial Free Credits: New users receive 10 free credits upon first signup.

Monthly Reset: Free credits reset to 10 on the 1st of each month for all users.

4.2 Credit Usage Priority

Credits are consumed in the following order:

1. Free credits (used first)
2. Subscription credits (used second)
3. Pack credits (one-time purchases, used last)

4.3 Paid Subscriptions

Paid subscriptions are available through Apple's App Store with the following tiers:

• Starter: €9.99/month or €89.88/year - 50 images/month
• Pro: €19.99/month or €179.88/year - 200 images/month
• Business: €39.99/month or €359.88/year - 500 images/month

4.4 One-Time Image Packs

One-time image packs are available for purchase:

• Small Pack: €4.99 for 20 images (never expire)
• Medium Pack: €9.99 for 35 images (never expire)
• Large Pack: €19.99 for 70 images (never expire)

4.5 Payment Processing

All payments are processed through Apple's App Store. By subscribing or purchasing, you agree to Apple's Terms of Service and payment policies. We do not store or process payment information directly.

4.6 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours prior to the end of the current period.

4.7 Cancellation

You may cancel your subscription at any time through your App Store subscription settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.

5. Refund Policy

5.1 Apple's Refund Policy

All purchases are subject to Apple's refund policies. Generally, you may request a refund within 14 days of purchase if:

• The App has technical issues that prevent its use
• You were charged incorrectly
• The App does not work as described

5.2 How to Request a Refund

To request a refund for subscriptions or in-app purchases:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find the Wrap It Up purchase
4. Select "Report a Problem" and follow the prompts

Alternatively, contact Apple Support directly. Refund decisions are made by Apple, not by us.

5.3 Image Quota Refunds

Unused monthly image quotas do not roll over and are not eligible for refunds. One-time image packs never expire but are non-refundable once used.

6. Prohibited Content & Acceptable Use

6.1 Prohibited Content

You agree NOT to use Wrap It Up to process:

• Images of minors (under 18) in any context
• Explicit, sexual, or nude content
• Violent, hateful, or discriminatory imagery
• Copyrighted images you don't own or have rights to
• Images for illegal purposes (counterfeit products, fraud, deception)
• Content intended to create deepfakes or impersonate individuals
• Harmful or dangerous content (weapons, drugs, self-harm)
• Protected or trademarked content without authorization

6.2 Consequences of Violations

Violations of our content policies will result in:

• Immediate account suspension or termination
• Deletion of all associated content
• No refunds for purchased credits or subscriptions
• Potential legal action if applicable
• Permanent ban for severe or repeated violations

6.3 Acceptable Use Requirements

You agree to use the App only for lawful purposes. You must not:

• Attempt to reverse-engineer or copy the App's functionality
• Share your account or subscription with others
• Use automated tools or bots to access the App
• Attempt to circumvent image quota limits or security measures
• Use the App in ways that could harm our services or other users
• Violate any local, state, national, or international law

6.4 Content Moderation & Reporting

Automated Safety Filters:

All photos are automatically processed through Google Gemini's built-in content safety filters, which detect and block:

• Child sexual abuse material (CSAM)
• Explicit sexual content
• Violent or graphic imagery
• Hate speech and discriminatory content
• Dangerous content (weapons, drugs, self-harm)

If your photo is blocked, you'll receive a generic error message. We do not provide specifics to protect privacy and prevent filter circumvention.

6.5 Enforcement Policy

Violations of our content policies result in escalating consequences:

• First Offense: Written warning via email + content removal
• Second Offense: Temporary account suspension (7 days) + content removal
• Third Offense: Permanent account termination (no refund)
• Severe Violations: Immediate permanent ban + referral to law enforcement if applicable (e.g., CSAM, illegal content)

6A. Age Requirements (17+)

6A.1 Minimum Age

You must be 17 years or older to create an account and use Wrap It Up.

6A.2 Legal Requirements

This age requirement is mandated by:

• COPPA (US): Children's Online Privacy Protection Act - requires parental consent for users under 13
• GDPR Article 8 (EU): Processing of children's data requires parental consent (age varies by country: 13-16)
• Apple App Store Guidelines: Apps with user-generated content and AI processing require appropriate age ratings
• Belgian Law: Protection of minors' data privacy

6A.3 Age Verification

• You must provide your date of birth during signup
• The App automatically calculates your age and blocks signup if under 17
• You must provide accurate age information
• Misrepresenting your age is grounds for immediate account termination

6A.4 Why 17+?

Our age requirement protects minors by:

• Avoiding complex parental consent requirements
• Ensuring users can legally enter into contracts
• Protecting minors from potential AI-generated content risks
• Complying with all applicable data protection laws

7. Intellectual Property & Copyright

7.1 Your Content & Copyright Warranties

You retain all rights to photos you capture and enhance using the App. We do not claim ownership of your content.

You represent and warrant that:

• You own all rights to photos you upload OR have explicit permission to use them
• Your use does not infringe any third-party intellectual property rights
• You will not use the service to create counterfeit or misleading product images
• You will not impersonate brands, individuals, or organizations
• You have all necessary rights, licenses, and permissions for any reference images used

7.2 AI-Generated Images

• You retain ownership of your original photos
• AI-enhanced versions are licensed to you for personal and commercial use
• You are responsible for ensuring AI-generated content complies with applicable laws
• Images may not be used to create misleading advertising or deceptive content
• AI-generated images may not be used for deepfakes, impersonations, or illegal purposes

7.3 Cloud Storage

• Storage: Your photos are securely stored in Cloudflare R2 cloud storage
• Access: Only you can access your photos (authentication required)
• Privacy: EXIF metadata (GPS location, device info) automatically removed before upload
• Cross-device: Access photos from mobile app and wrapitup.be/gallery
• Download: Download any photo (original or enhanced) anytime
• Deletion: Photos permanently deleted from cloud within 24 hours when you delete them or your account

7.4 Our Content

The App, including its design, features, and AI models, is protected by copyright and other intellectual property rights. You may not copy, modify, or distribute any part of the App.

7.5 Commercial Use

You may use enhanced photos for commercial purposes (e.g., selling products, marketing). However, you may not resell or redistribute the App itself or access to its AI enhancement features.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee:

• The App will be error-free or uninterrupted
• AI enhancement results will meet your expectations
• The App will be compatible with future iOS versions
• Your photos will be free from defects or errors
• Cloud storage services will be available 100% of the time

Backup Recommendation: While we use secure cloud storage (Cloudflare R2) with high reliability, we recommend downloading important photos to your device as a backup.

10. Limitation of Liability

To the maximum extent permitted by law, Wrap It Up shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including:

• Lost profits or business opportunities
• Data loss or corruption (including photos stored in cloud)
• Quality of AI-enhanced photos
• Service interruptions or technical issues
• Third-party service failures (cloud storage, database, AI services, payment processors)

Our total liability shall not exceed the amount you paid for the App in the 12 months prior to the claim.

11. Account Deletion & Data Management

11.1 Deleting Your Account

You may delete your account at any time through the App:

1. Go to Settings → Account
2. Tap "Delete My Account"
3. Confirm your decision (requires double confirmation)
4. Receive confirmation email

Immediate Effects:

• You can no longer log in to your account
• Profile and photo metadata deleted from database immediately
• Active subscriptions are canceled (no refund for current billing period)
• Custom camera modes deleted from your device

Data Deletion Timeline:

• Immediate: Account profile and metadata deleted from database
• Within 24 hours: All cloud photos permanently deleted from Cloudflare R2 storage
• Within 24 hours: CDN cache purged globally
• Within 30 days: All other data permanently removed

Data Retention After Deletion (Legal Requirements):

• Email address: Retained indefinitely for fraud prevention (GDPR Art. 6(1)(f))
• Financial records: Anonymized and retained for 7 years (Belgian law requirement)

11.2 Exporting Your Data

Before deletion, you can export all your data (GDPR Article 20 - Right to Data Portability):

1. Go to Settings → Account
2. Tap "Export My Data"
3. Receive complete data export via email (JSON format)

What's Included in Account Data Export:

• Account information
• Profile details
• Credit balance and history
• All transactions
• Purchase records

Exporting Photos:

Photos must be downloaded separately (not included in JSON export):

• In-app: Open Gallery → Tap any photo → Download button (choose original or enhanced)
• Website: Visit wrapitup.be/gallery → Download button on each photo
• Bulk download: Contact info@wrapitup.be for assistance with downloading all photos at once

Not Included in Account Export:

• Photos (download separately as described above)
• Custom camera modes (stored only on your device)

11.3 Termination by Us

We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination:

• Your right to use the App immediately ceases
• Active subscriptions may be canceled without refund
• You will be notified via email

12. GDPR Compliance

We comply with the EU General Data Protection Regulation (GDPR):

• Article 6: Lawful basis for processing your data
• Article 15: Right to access your data (view in Settings)
• Article 17: Right to erasure (account deletion)
• Article 20: Right to data portability (data export)

Legitimate Interest for Retaining Deleted Emails (Article 6(1)(f)):

We retain deleted email addresses to prevent abuse of our free credit system. This is our legitimate interest in protecting our business from fraudulent account creation. We implement the following safeguards:

• Minimal data retention (email address only, no other personal data)
• Clear user notification (this Terms document and Privacy Policy)
• Documented business justification
• Proportionate measure (prevents financial fraud)

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Belgium. Any disputes shall be resolved in the courts of Belgium.
